1. Introduction
These Terms of Service form a legally binding agreement between you and:
- High Speed Web Services LLC
- JUCRA Digital SL
Within this document:
- “The Provider”, “we”, “us”, or “our” refers to JUCRA Digital SL and/or High Speed Web Services LLC.
- “Customer”, “you”, or “your” refers to the individual or organisation using our services.
By purchasing, accessing, or using any hosting or infrastructure service supplied by us, you agree to be bound by these Terms.
2. Hosting Services
We provide various digital infrastructure and hosting services including, but not limited to:
- Shared Web Hosting
- Managed Hosting
- Cloud Hosting
- Virtual Private Servers (VPS)
- Dedicated Servers
- Email Hosting
- DNS Hosting
- Website Management
- Server Monitoring
- Website Migrations
All services are provided on a best-effort basis and may depend on third-party infrastructure providers, registries, network operators, software vendors, and datacentre facilities.
3. Account Security
Customers are fully responsible for:
- Maintaining secure passwords
- Securing devices used to access services
- Managing authorised users
- Maintaining updated software and scripts
- Protecting API keys and credentials
Sharing account access with third parties is entirely at the customer’s own risk.
Where possible, customers are strongly encouraged to enable Two-Factor Authentication (2FA).
Important: We reserve the right to suspend access where suspicious activity, credential compromise, malware activity, or unauthorised access is detected.
4. Acceptable Use Policy
Customers may not use our services for any unlawful, abusive, harmful, or disruptive activity.
Prohibited activities include, but are not limited to:
- Spam or unsolicited email distribution
- Phishing websites or impersonation
- Malware distribution
- Botnets or command-and-control systems
- Cryptocurrency mining on shared infrastructure
- Hosting pirated or illegal content
- Distributed Denial of Service (DDoS) attacks
- Unauthorised network scanning
- Copyright infringement
- Hosting content that violates applicable law
We reserve the right to suspend or terminate services immediately where abuse is detected.
5. Resource Usage
Shared hosting environments operate on pooled infrastructure.
Customers agree not to excessively consume system resources in a manner that negatively impacts other users.
Excessive Usage
- CPU usage
- Memory usage
- Disk I/O activity
- Email sending
- Database queries
- Storage consumption
Possible Actions
- Throttle services
- Temporarily suspend accounts
- Recommend upgrades
- Restrict abusive processes
Unlimited hosting does not mean unlimited physical infrastructure resources.
6. Email Services
Email hosting services are provided subject to fair usage, anti-spam policies, and infrastructure limitations.
Customer Responsibilities
- Securing mailbox passwords
- Maintaining endpoint security
- Preventing compromised devices from sending spam
- Managing mailbox storage quotas
Outbound Email Restrictions
- Spam activity is detected
- Accounts are compromised
- Mail queues threaten infrastructure stability
- Blacklisting events occur
Email delivery is not guaranteed and may be affected by recipient filtering, DNS issues, spam reputation systems, third-party outages, or internet routing issues.
7. Backups & Data Responsibility
Important: While we may perform backups as part of certain hosting services, customers remain solely responsible for maintaining independent backups of their own data.
Backups may not be available on all services, may be retained for limited periods only, may not guarantee point-in-time recovery, and may fail without notice.
We strongly recommend customers maintain external backups independent of our infrastructure.
We are not liable for data loss under any circumstances.
8. Fees, Billing & Payments
All services are billed in advance unless otherwise agreed in writing.
Failure to make payment by the due date may result in:
- Service suspension
- Late fees
- Data removal
- Account termination
Services suspended for non-payment may be deleted permanently after a reasonable retention period.
Customers remain responsible for ensuring valid payment methods are maintained.
Chargebacks or payment disputes may result in immediate suspension of all related services.
9. Suspension & Termination
We reserve the right to suspend or terminate services immediately where:
- Abuse is detected
- Malware activity occurs
- Non-payment arises
- Security threats are identified
- Illegal content is discovered
- Infrastructure stability is threatened
In urgent cases, services may be suspended without prior notice to protect infrastructure integrity.
10. Uptime & Availability
We aim to provide high availability services; however, uninterrupted operation cannot be guaranteed.
Service interruptions may occur due to hardware failures, software updates, security incidents, network outages, datacentre maintenance, or third-party provider failures.
Maintenance windows may occasionally require scheduled downtime.
We are not liable for losses resulting from service interruptions.
11. Security & Abuse Handling
We actively monitor infrastructure for intrusion attempts, spam activity, brute-force attacks, malware infections, and network abuse.
We reserve the right to:
- Block IP addresses
- Suspend compromised accounts
- Disable vulnerable scripts
- Restrict outbound traffic
- Quarantine infected systems
These actions may be taken without prior notice where infrastructure protection requires immediate action.
12. Limitation of Liability
To the fullest extent permitted by law, our total liability relating to any service shall not exceed the total fees paid by the customer for the affected service during the preceding twelve (12) months.
We are not liable for:
- Loss of profits
- Loss of business
- Loss of reputation
- Loss of data
- Indirect damages
- Consequential damages
All services are provided “as-is” and “as-available”.
13. Customer Content & Ownership
Customers retain ownership of their website content and uploaded materials.
Customers warrant that all hosted content belongs to them or is properly licensed, does not infringe third-party rights, and complies with applicable laws.
We reserve the right to remove content where legally required or where infrastructure abuse is involved.
14. Migration Services
Website and email migration services are provided on a reasonable-effort basis.
While we take care during migrations:
- Downtime may occur
- Configuration differences may exist
- Third-party limitations may affect outcomes
- Full compatibility cannot be guaranteed
Customers remain responsible for validating functionality after migration completion.
15. Legal Compliance
Customers are responsible for ensuring their use of our services complies with applicable local laws, GDPR requirements, copyright laws, consumer protection laws, and export control regulations.
We may comply with lawful requests from courts, law enforcement agencies, registries, or regulatory bodies.
16. Modifications to Services
We reserve the right to modify infrastructure, service specifications, pricing, policies, and software platforms.
Where practical, reasonable notice will be provided before material changes take effect.
17. Governing Law
These Terms shall be governed by the laws of Spain. Any disputes arising from the use of our services shall fall under the jurisdiction of the Spanish courts.
18. Binding Agreement
